Attica inmate serving life sentence convicted of gang assault in prison

A Rochester man in prison for the 2012 murder of a young community activist was convicted by a jury of taking part in a violent gang assault in Attica Correctional Facility.

It took a Wyoming County jury 20 minutes to find Devante Spencer, 24, guilty of gang assault in the first degree, assault in the first degree and promoting prison contraband. He was prosecuted by Special District Attorney Michael J. Flaherty Jr., former acting DA in Erie County, who said this was his first jury trial since 1999.

Spencer, who already is serving a life sentence for his part in the fatal shooting of Rochester teen advocate Lawrence Richardson, 22, took part in an ambush in Attica's C Yard on Oct. 8, 2016, according to Flaherty. He and at least two others (one of whom has pleaded guilty) were seen on closed-circuit monitors cutting their victim – a video that also was shown to the jury.

Judge Michael Mohun will have the option of sentencing Spencer to another life term as a persistent felony offender, which would be a factor if Spencer is ever considered for parole on the murder conviction.
