Couple charged with obstruction of justice in fatal drug overdose

A couple has been arrested and charged with obstruction of justice in the Dec. 28, 2018, fatal drug overdose of an employee in the City of Tonawanda, according to the U.S. Attorney's Office.

Prosecutors said the charge against Kevin Toth, 29, of the City of Tonawanda, and Samantha Yeates, 27, of Depew, carries a maximum penalty of 20 years in prison.

Assistant U.S. Attorney Jeremiah E. Lenihan said Yeates was caught on security video inside a red pickup truck in the Snyder Industries parking lot. The video shows Toth approaching the vehicle, before walking back inside the building towards a workspace, where Toth allegedly hands an item to another man.

Security video then allegedly showed the other man walking towards a bathroom, where a short time later he was found by City of Tonawanda police and fire personnel unresponsive and in close proximity to a hypodermic needle.

It was later determined that the man died of acute intoxication by fentanyl, prosecutors said.
