The operator of Western New York's last Perkins restaurant has filed for bankruptcy protection.
Pennsyvania-based Campbells Land Co. owns 27 Perkins locations, including the one on West State Street in Olean. It comes after its corporate parent company, Perkins & Marie Callender's LLC , filed a lawsuit against the operator, saying it defaulted on more than $2.2 million in fees related to the franchise, including royalties and advertising fees.
The Olean store was open and operating Friday afternoon.
The 27 Perkins stores were in bankruptcy when Campbells Land Co. bought them last year for $7.8 million. Campbells had vowed to invest $12 million into upgrading the restaurants.
Perkins has 117 company-owned stores and 254 franchised ones. Aside from the Olean store, the closest Perkins to Buffalo is in Niagara Falls, Ont.
