A man has been charged in Friday's fatal one-car crash in Chautauqua County that killed his brother, the county Sheriff's Office announced Thursday.
James A. Newell, 41, of Steamburg, faces several charges, including unauthorized use of a vehicle and reckless driving, in the crash that killed Paul R. Newell, 43, of Coldspring, the Sheriff's Office said.
The crash happened at 11:20 a.m. Friday on Gerry-Ellington Road in Gerry. Paul Newell, who was partially ejected from the vehicle, was pronounced dead at the scene. The men were driving a vehicle taken from a farm in Cattaraugus County where one of the brothers worked. They were believed to be driving to Jamestown at the time of the crash, deputies said.
Witnesses told police the vehicle was seen driving erratically and at a high rate of speed before the crash. Authorities believe the vehicle went into a ditch and then into an area with some brush and trees.
James Newell, who had to be extricated from the wreckage and was treated for non-life-threatening injuries, also was ticketed for unsafe passing, failure to keep right and imprudent speed.
