Five residents who live near a Lewiston farm where a commercial solar project has been approved have filed suit in State Supreme Court to block the project.
The 5.3-megawatt project would cover 16.5 acres off Swann Road, owned by Timothy Masters, a town building inspector. Borrego Solar Systems, a Massachusetts company, is the developer.
The neighbors seek to overturn the Town Board's Sept. 24 approval of the plan.
The lawsuit contends that Borrego's application was inadequate under several provisions of the town solar code, and that the project violates the town and Niagara County comprehensive plans.
Neighbors called the project an eyesore and contend Masters has a conflict of interest despite his recusal from the project's review.
Town Attorney Brian D. Seaman said the town is reviewing the suit and "will respond appropriately."
