Donald Kill, 63, was uninjured, troopers said. State Police found Kill was driving with a suspended license and later determined to have had a .13 percent blood alcohol content at the time of the crash.
State Police said Kill had two prior DWI convictions within the last 10 years and is required to operate a vehicle with an ignition interlock device.
Kill was additionally charged with first-degree aggravated unlicensed operation of a motor vehicle, operating a motor vehicle with no ignition interlock device and other vehicle and traffic violations, State Police said.
Kill was arraigned in Cheektowaga Town Court and held in custody. He was scheduled to return to court Feb. 28.
