Amherst proposes new restriction on adult businesses

Amherst wants to make sure adult businesses in the town have paid their taxes.

The Town Board on Tuesday approved a measure adding this requirement to the zoning code standards that sexually oriented businesses must meet to operate in the town.

Supervisor Brian Kulpa said the town won't issue the required annual license to adult businesses delinquent in their property taxes. The change would apply to at least two businesses: Adult Galaxy, 2113 Niagara Falls Blvd., and Xsentuals, 6840 Transit Road.

Xsentuals has kept up with its taxes.

The owner of Adult Galaxy, Nasser Alkhatib, regularly delays paying school taxes until the following year, county real property records show. He has racked up thousands of dollars in interest and fees, and was threatened with foreclosure, but is up to date now.
