Facing up to 8 years in prison, Elma man gets 3 years in child porn case

When Kevin D. Waczkowski appeared in court Friday, he was facing a recommended sentence of between 6 1/2 and 8 years in prison.

Instead he got three years for his possession of child pornography conviction, and U.S. District Judge Lawrence J. Vilardo offered a laundry list of reasons why.

He pointed to the fact that Waczkowski never distributed child pornography, never had sexual contact with a minor and has led an otherwise law-abiding life.

"Judge Vilardo engaged in a very through and thoughtful evaluation, and we appreciate his significant downward departure from the sentencing range," said defense lawyer Barry N. Covert.

The prosecution, led by Assistant U.S. Attorney Stephanie Lamarque, said a forensic examination of Waczkowski's devices found thousands of images of child pornography.
