Judge denies attorney's bid to stay Rogowski ouster

An Appellate Division judge Thursday denied a request to allow ousted Cheektowaga Councilman James Rogowski to remain on the Town Board while he appeals an earlier decision that removed him from public office.

Rogowski's attorney, James Ostrowski, had sought to stay a court order removing Rogowski from the board.

Appellate Division Justice Patrick NeMoyer denied the motion at a hearing conducted Thursday.

State Supreme Court Justice Mark Montour ruled Tuesday that Rogowski automatically vacated his council seat when he pleaded guilty to misdemeanor contempt stemming from a domestic incident involving his wife that occurred earlier this year.
