A Cattaraugus County man has been arrested by Erie County Sheriff's deputies following a two-month investigation into a rollover crash that occurred on July 1 in Sardinia.
Richard Smith, 31, of Delevan was charged with three counts under Leandra's Law, and multiple counts of endangering the welfare of a child, according to the Erie County Sheriff's Office. The rollover crash occurred on Middle Road in Sardinia, and resulted in five passengers – including a 3-year-old, a 2-year-old and a 6-month-old – requiring treatment at area hospitals for injuries that were not life-threatening injuries that resulted from the crash.
Deputies said they obtained a blood sample from Smith following the crash, and a subsequent toxicology report indicated the presence of a substance that led to Smith's impairment while driving. As a result, deputies charged Smith with three felony counts of aggravated driving while intoxicated because he had passengers in the vehicle who were under 16 years of age, and three misdemeanor counts of endangering the welfare of a child.
Smith surrendered to deputies Wednesday at the Erie County Sheriff's Office Springville Substation, where he was processed and later released with an appearance ticket for Town of Sardinia Court.
