A driver whose vehicle overturned when he swerved to avoid a deer on Boston-Springville Road in the Town of Concord faces a charge of driving while intoxicated, according to State Police in Boston.
State Police troopers said Jeremy Zabawa, 24, of Trevett Road, Boston, lost control of his vehicle shortly after midnight Saturday, left the highway and rolled over several times, striking a parked car, which was unoccupied.
Officers said an investigation led them to believe that Zabawa was intoxicated. He was taken to Erie County Medical Center, where he refused a chemical test, troopers said.
He was issued tickets to appear July 23 in Concord Town Court.
