Falls man weeps at four-year prison sentence in rape case

A man charged with having sex with an adolescent girl four times in 2016 and 2017 cried and dropped into a crouch when Niagara County Judge Matthew J. Murphy III sent him to prison Wednesday.

Kevin McBride, 22, of 23rd Street, Niagara Falls, had pleaded guilty to third-degree rape. Murphy sentenced him to four years, plus 10 years of post-release supervision.

After hearing that, McBride begged for probation.

But Murphy was dismayed by a probation officer's presentencing report.

"It says you don't have any positive attributes," Murphy told McBride.

According to the report, McBride smokes marijuana daily, doesn't have a job and is unwilling to follow instructions.

Assistant Public Defender Alan J. Roscetti said McBride never asked the girl's age, but he wasn't specifically looking for an underage girl.
