Niagara Falls man to serve 18 years in beating death of bystander in robbery

Shaquan O. Herbert was sentenced Monday to 18 years in state prison for a fatal beating on his way to commit a robbery in a Niagara Falls apartment house.

Herbert, 23, of Ontario Avenue, Niagara Falls, had pleaded guilty to first-degree manslaughter for the April 12, 2017, death of Jose Hewitt, 59. Hewitt died of a heart attack after the beating at the entrance to 617 Pine Ave.

Hewitt, who lived in the building, let Herbert and Devante L. Beasley in. They robbed another resident. Beasley, 19, of Weston Avenue, awaits sentencing on his guilty plea to first-degree robbery.

Scheduled for trial on murder charges Aug. 6 are Anthony K. Mallory, 23, who allegedly planned the robbery, and Stephanie J. Raymond, 19, who allegedly drove the getaway car.

Herbert was "the main participant in a beating that caused the death of Mr. Hewitt," Niagara County Second Assistant District Attorney Mary Jean Bowman said.
