Sinclair, 38, waited in his car for an hour on Aug. 30, 2016, outside the Niagara Falls home of Cameron M. Weingartner, 44, and attacked him when Weingartner returned home from work. Weingartner suffered a brain injury and remained unresponsive until his death May 26 in Erie County Medical Center.

"I don't think he intended to kill him," State Supreme Court Justice Richard C. Kloch Sr. said. Sinclair pleaded guilty to first-degree manslaughter.

"No time is going to be enough," said Weingartner's mother, Deborah Johnson.

Weingartner's brother, Staff Sgt. Aram J. Bass of Niagara Falls, died in combat in Iraq in 2005.
