Drug suspect arrested after traffic stop reveals outstanding warrant

A Batavia man is charge with four drug-related felonies after his arrest last week following an investigation by the Genesee County Drug Enforcement Task Force.

Benito A. "Red" Gay, 29, of Vine Street faces two counts of criminal sale of a controlled substance and two counts of criminal possession of a controlled substance, all in the third degree and all Class B felonies.

According to the Genesee County Sheriff's Office, Gay first was ticketed during a traffic stop Thursday evening for DUI drugs, unlawful possession of marijuana, unlicensed operation and a registration violation, and released. However, deputies then discovered Gay was the subject of a grand jury indictment warrant on the felony charges and he was arrested at his home. The indictment alleges Gay sold crack cocaine to a drug task force agent on two separate occasions in the past four months.

Gay was being held in Genesee County Jail without bail while awaiting arraignment.
