Paralyzed man in wheelchair avoids jail for beating son

A paralyzed man in a wheelchair was sentenced Tuesday to five years on probation for beating his 11-year-old son with a wooden backscratcher in May 2016.

State Supreme Court Justice Richard C. Kloch Sr. said Randolph R. Scott Jr. deserves to go to prison, but Kloch didn't send him there because of Scott's health issues, including two upcoming surgeries.

Scott, 39, of Main Street, Niagara Falls, had pleaded guilty to a felony count of attempted second-degree assault. It was the third time he had been prosecuted for injuring a child. Defense attorney James J. Faso Jr. called this case "corporal punishment."

Scott said his actions were "terribly wrong."

"I'm deeply embarrassed," added Scott, who is barred from further contact with the boy.
