A Niagara Falls man who bit off parts of another man's ear during a New Year's Eve domestic incident avoided jail time Tuesday.
Niagara County Judge Matthew J. Murphy III ordered five years' probation for Craig M. Moss, 34, of Seventh Street, who had pleaded guilty to a reduced charge of attempted second-degree assault. If Moss were to violate probation rules, he risks being resentenced to as long as four years in prison.
Prosecutors said Moss was choking the other man when he bit off parts of the top and bottom of the victim's ear. Doctors were able to reattach the top part, but not the bottom.
Moss earned the sentence through a satisfactory performance during six months on interim probation.
