New lawsuit filed against Lewiston hazardous waste landfill, DEC

Two Niagara County residents are suing the state Department of Environmental Conservation and CWM Chemical Services and its parent company, Waste Management, in an effort to block the treatment and storage of PCBs and other hazardous waste at CWM's hazardous waste landfill in Lewiston.

The lawsuit, brought by Amy Witryol of Lewiston and Thomas Freck of Porter, alleges that shipments of PCBs and other hazardous waste continue to be sent to CWM's Balmer Road facility even after land disposal of hazardous waste stopped there two years ago because of a lack of capacity.

CWM seeks to expand its hazardous waste operation at the site. That application is under consideration by a state siting board.

More details are expected to be revealed this afternoon when Witryol and Freck meet with reporters in Lewiston.

As activists try to shut landfill, CWM ponders expansion

Officials at CWM didn't offer any initial response to the allegations.

“We are not commenting at this time as we haven’t even seen the complaint yet," said Lori Caso, a spokeswoman for CWM.
