Lockport man to serve jail time for attempted reckless assault against daughter

David R. Barnes, who pleaded guilty to injuring his 5-week-old daughter last year, was sentenced Monday to five years on probation, beginning with six months in jail, by Niagara County Judge Matthew J. Murphy III.

Barnes, 33, of Chestnut Ridge Road, Lockport, pleaded guilty to attempted reckless assault against a child for the April 16, 2016, incident.

Assistant District Attorney Robert A. Zucco said Abigail Barnes has recovered from brain bleeding, skull fractures and broken vertebrae. He contended that the father lost his temper and shook or struck the baby after she had a "diaper blowout."

But Zucco admitted, "I'm not sure we'd be able to convince a jury of that."

Barnes contended that his arm went numb as he was putting Abigail in her crib and he dropped her on the floor.
