Wrongful death lawsuit against Buffalo police likely to be settled

The City of Buffalo will likely settle a $600,000 wrongful-death lawsuit against a Buffalo police officer who shot and killed a robbery suspect in 2009.

Common Council's claims committee approved the settlement Friday. It was better to settle the lawsuit with the parents of Matthew Connors than to risk going to trial and possibly having to pay out millions of dollars, said Niagara District Councilman David A. Rivera.

Officer James T. Reese fatally shot Connors, 23, on Aug. 7, 2009, after Reese went to Connors’ East Eagle Street apartment to question him about a robbery. Reese told investigators he shot Connors because Connors pulled a gun on him. Police learned later that Connors' weapon was only a replica.

No charges were filed against Reese, but Connors’ family sued the city for $3.1 million.

Common Council will consider the settlement at its meeting Tuesday.
