The Town of Amherst won another legal round against the owners of the former Westwood Country Club when a State Supreme Court judge on Friday agreed to allow the town to continue its review of the project's environmental impact.
Mensch Capital Partners had filed suit earlier this month seeking to prevent the Town Board's "accelerated" review of its mixed-use proposal to redevelop the 170-acre site.
Mensch previously lost its bid for a temporary stay blocking the Sept. 18 public hearing.
Then, Justice Joseph Glownia on Friday denied Mensch's request for a preliminary injunction. That means the town can close the public comment period on Monday and move forward with its plans to issue a final generic environmental impact statement, likely sometime in November, said Wendy Marsh, an attorney with Hancock Estabrook who represents the town.
The broader Mensch lawsuit continues.
