Jury acquits Lockport man in assault trial

A Niagara County Court jury deliberated about four hours Wednesday before acquitting a man of charges that he inflicted a sinus fracture on another man by punching and kicking him in the face.

George E. Butterson, 44, of Genesee Street, Lockport, was convicted only of harassment, a non-criminal violation, for striking another man in the face during the same Feb. 24 incident in a Washburn Street apartment. Judge Matthew J. Murphy III sentenced Butterson to time served.

Three men were reportedly drinking heavily when Butterson allegedly showed up and got into an argument with them. Defense attorney Michael H. White Jr. told the jury the injured man might have hurt himself by falling face-first into a stove or radiator. The victim testified he couldn't remember the incident.
