A former nurse at a Wheatfield drug rehabilitation facility who had sex with two male patients last year faces a possible four-year prison sentence as she admitted Tuesday that she violated probation terms.
Candace A. Seelbinder, 36, of Whitney Avenue, Niagara Falls, is to be resentenced Sept. 25 by Niagara County Judge Matthew J. Murphy III.
On Feb. 28, he sentenced Seelbinder to 10 years' probation for third-degree rape. Seelbinder admitted that she failed to obtain sex offender counseling, used cocaine, disobeyed her curfew and used social media, all violations of probation rules.
Under state law, inpatient drug rehab clients are considered unable to consent to sex. Seelbinder, a Level 2 sex offender, was one of two nurses to plead guilty in the case at the First Step center.
