Derek M. Stewart, a Niagara Falls man who was on parole when 2.66 ounces of cocaine was seized from his home in a police raid last year, accepted a plea offer Tuesday.
Stewart, 33, of Sixth Street, will be sentenced Oct. 10 to no more than four years in prison, state Supreme Court Justice Richard C. Kloch Sr. promised. It's Stewart's third felony conviction in the past 11 years.
Stewart, who also agreed to forfeit $1,466 police found in the home, was on parole at the time of the raid from a 2 1/2-to-five-year sentence for a 2013 reckless endangerment conviction. He will have to complete that sentence before starting the new prison term. Stewart also served three years for a 2006 drug possession conviction.
