Buffalo driver who fled scene after hitting tree charged with DWI

A Buffalo driver who struck a tree Tuesday night near Allentown was later arrested on the West Side and charged with with driving while intoxicated, according to a city police report.

John Tate III, 29, of North Street, hit a tree at Linwood Avenue and Summer Street at about 8:45 p.m., according to the police report.

Tate drove away and about 45 minutes later was located at West Delavan Avenue and Dewitt Street, more than 2 miles away. Officers reported Tate was uncooperative and refused to be handcuffed.

The police report did not indicate how Tate and his vehicle were located.

Tate was charged with DWI, first-degree reckless endangerment, resisting arrest, leaving the scene of an accident without reporting and two counts of second-degree obstruction of governmental administration.
