Driver in Tops parking lot fatality won't be charged

No criminal charges will be filed in connection with the June death of a woman hit by a vehicle in the Tops Markets parking lot in East Aurora. The driver is being cited for traffic violations.

East Aurora-Town of Aurora police issued a press release Wednesday that said they and the Erie County District Attorney's Office found no criminal wrongdoing by the 18-year-old man whose vehicle struck Wendy L. Bus, 48, of Colden on June 25.

The driver was backing up in the lane in front of the store when he struck Bus as she was pushing a shopping cart to her vehicle. The driver, who police have not identified, will be cited for unsafe backing, failure to exercise due care and unsafe start.
