Niagara Falls father of five draws probation in gun case

A father of five was placed on five years' probation Thursday for firing a gun on a Niagara Falls street when there were several people in the vicinity.

"It's clear to me you didn't go there with the intention to endanger anyone," Niagara County Judge Matthew J. Murphy III told Demetrius R. Hayes, 29, of Pierce Avenue in the Falls.

Hayes pleaded guilty to a charge of first-degree reckless endangerment in the July 16, 2016, incident on Whitney Avenue.

If Hayes violates probation, he risks resentencing to as long as seven years in state prison. Charges against two other men present at the scene were dropped after Hayes pleaded guilty May 12.
