Lockport man pleads guilty to felony in injury to infant daughter

Town of Lockport's David R. Barnes, charged with assaulting his five-week-old daughter last year, took a plea deal Wednesday.

Barnes, 33, admitted to a reduced felony count of attempted reckless assault of a child in connection with the injuries to his daughter, Abigail Barnes. Niagara County Assistant District Attorney Robert A. Zucco said the girl suffered brain bleeds, skull fractures and broken vertebrae in her neck and low back.

Zucco accused Barnes of  "slamming, throwing, or causing the child's head to impact on a hard surface" in Barnes' Chestnut Ridge Road home April 16, 2016. Zucco said Abigail seems to have made a full recovery.

"I dropped her on the floor," Barnes told County Judge Matthew J. Murphy III, who could send Barnes to prison for up to four years at sentencing Sept. 15.

The girl's mother, Bethany Barnes, declined to say whether she believes her estranged husband's account.
