Sentencing delayed for East Aurora man in child sex case

The sentencing in Erie County Court of an East Aurora man charged with having oral sex with a 6-year-old was adjourned Wednesday morning.

Charles Ernst, 33, was arrested Aug. 31, following an investigation prompted by information obtained by Child Protective Services.

Judge Michael Pietruszka on Wednesday granted the adjournment to allow defense attorney Paul G. Dell to compile a sentencing memorandum that will include letters from Ernst's mother and grandmother.

"His father beat him as a kid. He was in foster care," Dell told Pietruszka.

Ernst had accepted a plea deal and pleaded guilty to a misdemeanor sex charge. He was originally charged with predatory sexual assault against a child, a felony.
