The full Common Council will have to decide whether to amend the Green Code to accommodate a Dash’s Market plan for a larger Hertel Avenue supermarket.
Following a 90-minute public hearing Tuesday, the Council’s Legislation Committee sent Dash’s request to the Council, without a committee recommendation. The Council will decide next Tuesday whether or not to grant the request, which would allow Dash's to build an expanded market on the site by combining 10 properties.
All 10 speakers at the public hearing opposed amending the city’s zoning map, known as the Green Code. They said Dash’s should go through the Zoning Board of Appeals to request variances.
Dash's argues that it is preferable to amend the Green Code than to apply for the myriad of variances.
Monday night, Dash's had appeared before the city's Planning Board, which granted initial approval. A half-dozen residents also had spoken against the plan Monday night.
