A Buffalo man is charged with murder in the first and second degrees in connection with the fatal stabbing of his ex-girlfriend’s new boyfriend.
Hillard Smith, 46, was arraigned Friday in Erie County Court on the murder charges and on charges of third-degree assault, second-degree menacing, two counts of criminal possession of a weapon and two counts of criminal contempt.
Prosecutors allege that Smith broke into the woman’s apartment at 518 North Division St. and stabbed Justin Johnson, 42, with a knife. Johnson died five days later at Erie County Medical Center.
Also five days later, Smith was arrested in Niagara Falls.
If convicted as charged, Smith could face a maximum possible sentence of life in prison without parole. He is being held without bail and is next scheduled to be in court July 10.
