LOCKPORT - Niagara Falls City Councilman Ezra P. Scott Jr. pleaded not guilty to a misdemeanor driving while intoxicated charge Wednesday.
Scott was arraigned by Lockport City Judge William J. Watson, who was assigned the case after all of the Niagara Falls judges recused themselves.
Defense attorney John V. Elmore said he has discussed a possible disposition in the case with Niagara County Assistant District Attorney Theodore A. Brenner. Watson adjourned the case until June 7.
Before Scott's appearance, Watson granted conditional discharges, community service and fines on impaired driving pleas to two other drunken drivers who, like Scott, had no previous arrests. Asked if he foresees a similar outcome for Scott, Elmore said, "It's a little too early to tell."
Scott was arrested at 4:50 a.m. March 11, when police said his vehicle struck a utility pole and a parked car in the 300 block of Hyde Park Boulevard in the Falls.
Scott declined to comment.
