Malpractice case against VA Medical Center dismissed

A federal judge has dismissed a $25 million medical malpractice suit against the Veterans Affairs Medical Center in Buffalo.

In rejecting the suit, U.S. District Judge William M. Skretny said the plaintiffs, Edward and Roxanne Blake, "failed to prove” their malpractice claims.

The Blakes, in their suit, claimed the VA failed to issue a timely diagnosis and treat Edward Blake's cauda equina syndrome, a condition that results in swelling and pressure on nerves at the end of the spine.

Skretny found that Blake's doctors at the VA acted in a timely manner and specifically pointed to the surgery that was done within 24 hours after he first showed symptoms at the VA.

Assistant U.S. Attorneys Michael S. Cerrone and Mary E. Fleming represented the VA.
