Rickey D. Roberts has four previous DWI convictions and his driver's license has been suspended nine time.
But that didn't stop the Buffalo man from drinking and driving again Wednesday, Orchard Park police said.
Orchard Park police said they found Roberts at about 1:30 a.m. on Abbott Road near Milestrip Road with a flat tire on his vehicle. Roberts told officers he struck the curb.
Roberts failed several field sobriety tests, according to police, and refused to submit to a roadside breath test.
Police charged Roberts, 51 with misdemeanor DWI, felony DWI, failure to install an ignition interlock device, failure to surrender a suspended driver's license, failure to submit to a roadside screening device, and first- and second-degree aggravated unlicensed operation, according to police.
Town Justice Edward Pace arraigned Roberts, who was remanded to the Erie County Holding Center pending a felony hearing in town court, police said.
