A Lake View man received the maximum allowable prison term for setting a fire that spread to a neighbor's home.
Gerald May, 53, was sentenced by Justice M. William Boller to one and one-third to four years in prison when he appeared in State Supreme Court. May pleaded guilty in December to arson in the fourth degree, starting a fire that recklessly damages a building.
According to the District Attorney's Office, May was burning trash in the driveway of his Hamburg home on April 18 when the flames spread to a wooden fence and the eaves of a neighbor’s garage. The fire burned the walls and roof of the garage, filling the neighbor’s house with smoke.
Two people were home at the time. Kerrie Aquino, 33, had to help her father, Vincent Aquino, escape the smoke in his wheelchair.
The fire caused $7,575 in damage to the Aquinos’ home, which they had to leave while it was repaired.
