Troopers charge driver with DWI, drug possession after Thruway crash

A Monroe County man who crashed into a guardrail on the Thruway in Hamburg on Wednesday night faces charges of driving while intoxicated and possessing concentrated cannabis, the State Police said.

Troopers responded to a one-car crash near the Hamburg/East Aurora/Route 75 exit at about 8:38 p.m. The driver, Matthew M. Fogarty, 25, of Pittsford, was found to be intoxicated and in possession of concentrated cannabis in both liquid and wax form, State police said.

Authorities believe Fogarty crossed over two lanes before striking the guardrail.

At the Buffalo barracks, Fogarty registered a blood-alcohol level of 0.12 percent. He was charged with fifth- and seventh-degree criminal possession of a controlled substance, DWI and several vehicle and traffic violations, according to the State Police.

He was arraigned and is due back in court on Monday.
