MACHIAS -- A handcuffed defendant who tried to run from the courthouse managed to grab a trooper's firearm as the two fell to the ground and fire a shot into a snowbank Tuesday afternoon.
Gavin C. Haynes, 17, of Machias, who was handcuffed behind his back, was quickly captured. As he and a trooper fell the trooper's firearm fell from the trooper's holster, State Police said. That enabled Haynes to grab it.
Haynes was arraigned on first-degree robbery, second-degree criminal possession of a weapon, reckless endangerment and escape and on a third-degree criminal trespass charge for an earlier incident. He was jailed without bail at the Cattaraugus County Jail in Little Valley, according to State Police.
