One hundred forty people reported getting sick after eating at Mighty Taco locations in Erie and Niagara counties last week, but the reports stopped after Oct. 6, the Erie County Department of Health announced Tuesday.
Tests are being conducted at the State Health Department's lab in Albany on suspected batches of refried beans that were supplied by a third-party to the taco chain.
"Suspect food products related to this investigation were removed from all Mighty Taco locations on Oct. 6 and subsequently discarded," said Erie County Health Commissioner Dr. Gale Burstein.
Inspections of the Mighty Taco sites found "no additional food products or food handling practices were implicated," said Jeffrey Jurewicz, Senior Public Health Sanitarian. "Mighty Taco’s food safety inspection record with our department, across all their locations in Erie County, has been exceptional."
