An elderly man is not being charged following an incident involving children at the McDonald’s on Grand Island over the summer.
The Erie County Sheriff’s Office investigated a July 1 report by a mother who said the man crawled into the play area at the Grand Island Boulevard restaurant. He then crawled into a slide and a child couldn’t get out because the man wouldn’t let her move, the mother’s Facebook post said.
The man was on top of her daughter and wouldn’t move, the mother wrote, and he then told her daughter to “go between my legs.”
“He was not charged for that incident as no crime was committed,” Scott E. Zylka, spokesman for the sheriff’s office, said in an email.
The child’s mother posted about it on Facebook, a post that has been shared more than 11,000 times.
