AK-47 found beneath Christmas tree in Niagara Falls apartment after gunfire

NIAGARA FALLS – Shots were fired Monday night on Pierce Avenue and police later recovered an AK-47 beneath a Christmas tree in the apartment of a man charged with menacing.

Officers responded to the area of Pierce Avenue and 22nd Street at about 9:30 p.m., according to a Niagara Falls police report.

Witnesses told police several shots were fired, but no one was injured, according to the report. A man on the porch of a 22nd Street home, who was described as being intoxicated, tried to entice them to fight and then fired the shots before running into a home on the 1300 block of 22nd, they told police.

Police charged Jacob N. Shimmel, 28, with second-degree menacing.

Shimmel, of 22nd Street, was found in his apartment where a woman and two children were also living, according to the police report.

In addition to the assault rifle located in the apartment, police also confiscated 12 long guns, three pellet guns, a crossbow, a compound bow and a baton, according to the report.
