Niagara Falls man botches plea deal in sex case

LOCKPORT – A man who was allowed to plead guilty to a misdemeanor after having sex with an underage girl, and then was placed on probation, was sentenced to a year in the Niagara County Jail Wednesday after failing to obey the probation rules.

“I guess I’ll never know why you were so noncompliant with probation when you got such a good break,” County Judge Sara Sheldon told Arriel J. Pettigrew, 23, of Weston Avenue, Niagara Falls.

Pettigrew, originally indicted for third-degree rape in the wake of the May 17, 2014, encounter, a year later was allowed to plead guilty to sexual misconduct. He admitted he had sex with the adolescent girl without her consent and was rated a Level 1 sex offender, the least serious category. If convicted as originally charged, he could have gone to state prison for as long as four years.
