LOCKPORT – A Niagara Falls man, serving a five-year prison sentence for illegal gun possession, has been indicted in connection with an assault that allegedly occurred six days before his sentencing.
Cody A. Rolfe, 33, of Mackenna Avenue, a three-time felon, pleaded not guilty in Niagara County Court on Tuesday to second-degree assault and attempted second-degree assault.
Assistant District Attorney Joel M. Grundy said the alleged street attack on April 21, in which another man was punched and kicked, was caught on video. The victim suffered cuts and bruises, Grundy said.
On April 27, Niagara County Judge Sara Sheldon sent Rolfe to prison for five years for having an unregistered handgun.
