Town of Niagara man charged with having stolen gun

LOCKPORT – A man who allegedly had a stolen handgun in his Town of Niagara home pleaded not guilty to a SAFE Act violation Thursday in State Supreme Court.

Anthony M. Burge, 27, of Rhode Island Avenue, was arrested Dec. 14 and charged with criminal possession of a firearm and fourth-degree criminal possession of stolen property.

The former charge is a violation of New York State’s SAFE Act, which applies because the unregistered gun was in his home, Assistant District Attorney Claudette S. Caldwell says. However, the charge is less severe than if he had been caught with the gun on the street; the maximum sentence is four years in prison instead of seven years.
