Sentencing set for Falls man who shot cabbie

LOCKPORT – Sentencing has been scheduled for Aug. 5 for a Niagara Falls man who shot a cab driver in a robbery attempt last year.

Zachary D. Boos, 21, of 16th Street, pleaded guilty before Niagara County Judge Matthew J. Murphy III to a reduced charge of attempted second-degree assault, which carries a maximum sentence of four years in prison. Had he been convicted on the original indictment at trial, he faced a 25-year maximum sentence.

Cabbie Brian Sell was shot in the back about 4:30 a.m. Aug. 19 as he struggled with two robbers in the 400 block of Memorial Parkway. They fled without stealing any money. Boos was the only person arrested in the case.
