Missing items from fatal fire memorial in Batavia returned

A white cross and a teddy bear initially thought to have been stolen from a memorial in front of a fire-damaged Town of Batavia duplex have been returned, according to the Genesee County Sheriff’s Office.

No foul play is suspected.

They were taken by another family member who added some additional decoration and were not stolen, the Sheriff’s Office said Sunday.

The Sheriff’s Office considers the matter resolved.

Twin 2-year-old brothers died in a fire Friday night at the duplex at 8157 State Street Road.

The Sheriff’s Office, in a release issued early Sunday, previously indicated a theft happened after a memorial service, between Saturday evening and early Sunday morning.

The fire, reported to authorities at 10 p.m. Friday, engulfed the rear of a duplex. The boys, who were overcome by smoke inhalation, were found in a rear bedroom of the first-floor apartment by firefighters, according to the Genesee County Sheriff’s Office.

The victims were identified as Michael J. and Micah G. Gard. They were pronounced dead at the scene by Genesee County Coroner Thomas Douglas.
