LOCKPORT – Jermaine G. Ellison, who is to be sentenced next week on a drug felony, pleaded not guilty to a new drug indictment Wednesday in Niagara County Court.
Ellison, 29, of Bell Street, Niagara Falls, is charged with third- and fourth-degree criminal possession of a controlled substance for allegedly having more than one-eighth ounce of cocaine with the intention of selling it on Christmas Eve in Niagara Falls.
Ellison could go to state prison next week for as long as 2 1/2 years after flopping on interim probation. He pleaded guilty in April 2015 to attempted fourth-degree possession for having cocaine, marijuana and Xanax in his car March 20, 2014. He forfeited $5,560 in cash that Falls police also seized. Ellison failed to show up for a sentencing date in February; now he’s being held in lieu of $20,000 bail.
