Buffalo man sentenced to jail in DWI case

LOCKPORT – A Buffalo man, who was arrested for drunken driving only six days after completing a probation term for a previous alcohol-related driving offense, was sentenced Friday to a year in the Niagara County Jail.

“You blew it,” State Supreme Court Justice Richard C. Kloch Sr. told Eric D. Herndon, 50, of Brunswick Boulevard, who was pulled over in North Tonawanda March 11, 2015. Herndon, who refused the breath test, pleaded guilty in December to a felony count of driving while intoxicated.

After his release from jail, Herndon will face a one-year conditional discharge, and one of the conditions will be that he must pay fines and fees totaling $1,605.
