Orchard Park police charged a driver with having a blood-alcohol level three times the legal limit on Thursday after he crashed into a post in an alleyway.
Kevin P. Boyle, who was convicted of driving while intoxicated in 2003, drove his Lincoln Town Car into a post at 4247 North Buffalo Road.
Boyle was unhurt in the crash. He registered a blood-alcohol level of .24 percent, triple the legal limit of .08 percent, police said.
Police found an open liquor bottle in his car. His driver’s license was suspended because of a DWI arrest in Hamburg, a case which is still pending, police said. Boyle has a hardship privilege which allows him to drive in certain circumstances.
He was charged with driving while intoxicated, aggravated DWI, having an open alcoholic beverage in a vehicle, refusing to submit to a roadside breath test and other traffic violations.
Boyle was released after posting $200 bail and is scheduled to appear in Orchard Park Village Court on Thursday.
