GERRY – The Chautauqua County Sheriff’s Office on Monday charged a Town of Gerry man with a revoked driver’s license for a prior conviction for driving while intoxicated with driving with a blood-alcohol level more than double the legal limit.
Sheriff’s deputies pulled over David A. Spunaugle’s vehicle just after 1 a.m. on Gerry-Ellington Road.
Spunaugle, whose previous DWI conviction came within the last 10 years, registered a blood-alcohol content greater than .18 percent, more than double the legal limit of .08 percent, the sheriff’s office said.
Spunaugle was charged with felony DWI, aggravated DWI, first-degree aggravated unlicensed operation, driving without an ignition interlock device, failing to submit to a roadside breath test and moving from a lane unsafely. He was arraigned in Town of Ellery Court and remanded to the Chautauqua County Jail on $5,000 cash bail or $10,000 property.
