BATAVIA – A Batavia man faces an aggravated drunken driving charge after he was pulled over early Saturday for driving without his headlights.
Scott D. Higgins, 35, of West Main Street, was stopped just before 2:30 a.m. in the parking lot of a fast food restaurant on West Main.
Batavia Police charged Higgins with aggravated driving while intoxicated for having a blood-alcohol level greater than 0.18 percent, more than double the legal limit of 0.08 percent. He also was charged with third-degree aggravated unlicensed operation, DWI, driving without a license and failing to use headlights.
He’s due in Batavia City Court on April 27.
